Living Trust

Should your home be held in a living trust?  Being in real estate, I am constantly being ask this question.  And yes, I do hold my personal residence in a living trust.  However, I cannot recommend that you hold your North County home in a trust.  Only your CPA or attorney can answer that question for you.

  • Why do people use living trust?  Some common reasons for holding San Diego property in a trust is to postpone or minimize death taxes, to shield the property from some creditors, or to help avoid time consuming probate.
  • What is a living trust?   A living trust is a trust created during your life time (inter-vivos trust) rather than being created by your will at death.
  • Who are the parties to a trust?  Typically a living trust is a Family Trust in which the Husband and Wife are the Trustees, and usually their children are the Beneficiaries.
  • Does the trust hold title to real estate?  No, title is held by the trustees on behalf of the trust.
  • What taxes can be avoided by putting my property in a living trust?  You should check with your attorney.  Married couples can usually exempt a large part of their assets from taxes by having their property in a living trust.
  • Can you cancel a living trust?  The trustees can cancel a living trust at anytime.

Hottest Real Estate Markets

If you are wondering what will be the hottest real estate markets in the next 18 months, I will share with you CNNMoney’s opinion.  Sorry to say that San Diego real estate and North County real estate were not included.  In fact, only one California city was mentioned, Madera, California.  Even though local markets are not in the list, we know that San Diego North County real estate inventory is very low and decreasing.  This should start to cause our home prices to increase.  Waiting on the bottom of the San Diego home market, better get on board.

  2. Medford,  Oregon (Forecasted 21.5% gain through 2013)

San Diego North County Real Estate Facts – April 2011

Below the photo is a summary of current real estate conditions in San Diego North County.

• The median price for all North County home sales – attached and detached – increased from $358,000 in February 2011 to $393,500 in March 2011.
• Detached homes in North County rose 7.82 percent from $417,500 in February 2011 to $450,165 in March 2011, the largest monthly price increase in the past 12 months. Year-over median single-family detached homes in North San Diego County declined four percent, from $469,000 in March 2010, the second month of year-over declines following an 18-month trend of increases in median price (with the exception of August 2010).
• The number of single family detached North County listings (active and contingent) increased 3.93 percent to 4,626 ending March 2011, the third monthly increase. Year-over listings increased by 14.11 percent from March 2010.
• The number of sold North San Diego County SFD homes jumped 50 percent from February 2011 to March 2011 and increased 4.72 percent year-over from March 2010.
• Median days-on-market for single-family detached North County homes decreased from 69 days in February 2011 to 58 days in March 2011.

San Diego North County real estate market heats up.

San Diego is one of the five California real estate markets that turned positive in April or May.    San Diego home prices appreciated as much as 3.1% to 3.9%  since hitting lows in the previous year according to Zillow.  But missing the bottom doesn’t mean the opportunity is gone for North County buyers.  San Diego North County homes values are still down 30%  to 36%.   They still make a good investment for North County property buyers.

The San Diego North County real estate market is considered being balanced when there are six months of inventory on hand.  Market conditions are favorable to both North County buyers and North County sellers.  A buyer’s market is characterized by conditions such as falling prices, high inventories, concession by sellers, and incentives among other things.  A North County seller’s market has low inventories of North County homes for sale, increasing prices, and real competition between buyers, including multiple offers on many properties.Escondido Real Estate

North County Property Tax Refunds – Where Are They?

Where is your North County property tax refund on your North County home. The price of your North County property has gone down every year for the last four or five years. You have filed a request with the County to refigure your assessed value on you North County home, but you keep paying the high property taxes here in San Diego. You are in the same boat as thousands of other North County home owners.

I am including an article from the North County Times to expose the problem.

“The San Diego County Treasurer-Tax Collector’s office continues to take in millions of dollars more in property taxes than is owed and then lags in returning the money to taxpayers, according to a 2009 audit. The examination of the treasurer’s property tax refund account concluded that nearly $8 million needed to be refunded or funneled to the county’s general fund if the person or entity who was owed the money could not be located. It’s been a problem that stretches back to 2003 and has dragged on, despite a series of examinations in the years since. The most recent independent audit, conducted over nine months by the firm of Kessler International, found a variety of problems in how the treasurer’s office manages what is known as the Property Tax Trust and Refund account. That report was issued in March but never shared with the public.” Of course, this is an election year and Dan is running again.

This problem will not be easily solved, but Dan McAllister vows changes are being implemented to correct years-old problem.
