Peacock Hills History

The Peacock Hills homes were built by Ramos Jensen Company as an adult retirement community with a limit of no more than three persons per unit. One Peacock Hills resident must be 45 years of age and no household member may be under 18 years of age.
 
The Peacock Hills homes were built in four phases. Phase I was built in 1976 and Phase IV started in 1979. Phase I consisted of 220 Peacock Hills homes, Phase II 266 Peacock Hills homes, Phase III 160 Peacock Hills homes and Phase IV 274 Peacock Hills homes or total of 920 homes. This Peacock Hills real estate was configured as duplexes with single car garages. Two floor plans were available, Plan 10 and Plan 20 in 5 architectural variations, known as Plan A, Plan B, Plan C, Plan D and Plan E. Plan 20 was larger since it had a 100 square foot bonus section at the end of the garage area and slightly more house square footage. All four phases of Peacock Hills real estate had their own CC&Rs and Architectural Committees to enforce the CC&Rs.
 
The prices of the Peacock Hills homes were from $25,990 for a Plan 10, $26,990 for a Plan 20 in Phase I. The prices of the Peacock Hills real estate increased as the Phases were built and Phase IV prices were $41,990 for a Plan 10 and $42,990 for a Plan 20. Also a premium price was added for view and large lots. Here is an interesting note - There was an article in the Los Angeles Times on September 16, 1979, reporting that many buyers camped out as long as four days to purchase the final 274 Peacock Hills.
 
Ramos Jensen Company provided the original governing documents known as CC&Rs for Peacock Hills real estate. As the years progressed we found that amendments would have to be added to the CC&R's. However, for an amendment to be passed, it required at least a 75% vote of the Peacock Hills property owners, which is a difficult task to attain. So the Board of Directors of Peacock Hills homes met with our attorney to proceed to write an amendment which would require only a vote of not less than 51% of the homeowners for an amendment to be passed. With the help of the attorney the amendment was written and mailed to all homeowners for a vote. The amendment was passed in all four Phases and recorded at the San Diego North County Recorders Office.

With time the housing laws as to age and other requirements were changing at Federal and State level. In order for us to comply with the new senior laws, again we had to amend our original CC&R's in order to keep Peacock Hills Homes, a senior community. We went to our attorney to help draft an amendment to our CC&R's for the homeowners to vote to make Peacock Hills a senior community in order to comply with the new laws. The amendment was mailed to all the homeowners, it passed by the needed majority and it was recorded at the San Diego County Recorders Office.

The Board of Directors in our community were faced with old original archaic CC&Rs and a set of new of CC&Rs were due in order to incorporate all the new laws on housing that had been enacted since 1976. A CC&Rs committee composed of representatives from each Phase was formed. They met over several months and a new set CC&Rs and Bylaws were written and mailed to our attorney for his approval. The final CC&Rs for each Phase were mailed to all homeowners for their vote. They were approved by a majority of the homeowners in each Phase and were recorded in the San Diego County Recorders Office. With the recording of the new CC&R'S we are legally a senior community and have included in our CC&Rs the age requirement of age 55 as in the California Civil Code Section 51.3 and the Federal Fair Housing Amendments Act of 1988 as amended. Phase I, Phase II and Phase III are incorporated.

We have a Board of Directors that meets monthly to govern our community. They have done an outstanding job of maintaining Peacock Hills as a senior community, safe and attractive. Our community speaks for itself, homes have now appreciated in value with some recently selling at $200,000 and more.

This is an update on our Peacock Hills Community. In November 2004 the Peacock Hills Board of Directors of each of the four phases of Peacock Hills voted to merge the four phases of 920 homes into one unit. Ballots were mailed to all the Homeowners to vote on the proposed merger and for the new CC&Rs and Bylaws.

On January 10, 2005 the ballots were counted in the law offices of our attorney, Mr. Alan Burson and the majority of the Homeowners in each of the four units voted to merge the 920 homes composed of Phase I, II, III and IV and the entity to be known as Peacock Hills Senior Community Association, Inc.

The President and Secretary of Peacock Hills Senior Community Association, Inc. signed the "Certification of Adoption" of the new Declaration of Restrictions, their signatures were notarized and it was mailed to the San Diego County Recorder Office. The document was recorded on January 14, 2005.

This is an update as of February 2006. Our original CC&Rs dating back to 1976 stated that the yearly assessment would be $36.00 per year per home. The assessment has never been increased. Due to escalating operating costs the Board of Directors was faced with the unpleasant task to increase the annual assessment to $72.00 per year per home. The Board also decided to amend other sections of the existing CC&Rs and submit it for a vote to the Peacock Hills Homeowners. The amendments were mailed to the Homeowners for their vote. The majority of the Homeowners voted for the following: Section 3.1.1, Increase assessment to $72.00 per annum effective April 1, 2006. Section 3.3, Interest on nonpayment of assessment to be 7%. Section 9.5, Nuisances - revise original write-up. Section 9.12, Height Limitation. Section 9.13, Temporary & Accessory Buildings. Section 9.6.1, Garage and Other Exterior Doors added, and Section 9.19, Parking Restrictions added. The preceding Amendments and Additions to the existing CC&Rs were recorded at the San Diego County Recorder's Office on January 25, 2006.

The Board of Directors have set up a program of self management supplemented by contractors for accounting, legal service, phone answering and other services as may be required.
